Ratepayer Protection Act passes U.S. House of Representatives

The U.S. House of Representatives voted overwhelmingly by a margin of 417 to 3 to pass H.R. 9340, known as the Ratepayer Protection Act. Introduced by Representative Gabe Evans of Colorado and Representative Kathy Castor of Florida, the bipartisan legislation amends the Public Utility Regulatory Policies Act of 1978 to ensure that massive energy consumers—specifically large-scale data centers and computing facilities—bear the full financial responsibility for electrical grid upgrades required to power their operations.

Under the proposed federal standard, electric utilities would be required to structure rates for large-load customers to recover the full, incremental costs of any generation, transmission, or distribution upgrades necessary to meet their demand. The bill defines a large-load customer as a non-residential electric consumer operating information technology infrastructure for data storage and computational services with a peak electric demand of 100 megawatts or more at a single site or campus. Furthermore, utilities would be required to secure financial assurances or contributions upfront before making system upgrades, preventing energy companies from shifting infrastructure costs onto residential ratepayers if a large facility reduces power consumption or terminates its agreement.

Representative Derrick Van Orden of Wisconsin (WI-03), one of the bill's key co-sponsors, highlighted the necessity of the legislation for local ratepayers, stating that Wisconsin families should not be stuck paying higher utility bills to subsidize the massive energy demands of big corporations. The act mandates that state regulatory authorities and nonregulated utilities begin formal consideration of the standard within one year and complete implementation within two years, establishing robust protections against predatory utility rate hikes across the nation. With its overwhelming House passage, the bill now moves to the Senate for consideration.
